Obviously he does not need to do anything if the Senate takes no action. But, when it does, then he has to make them prove guilt and that includes recommending it his client does not submit any information he does not have to.

However, in a criminal case, they must find the person guilty beyond a reasonable doubt. That standard obviously does not apply in a Senate trial.
