Another is the 3rd, 4th, and 5th amendments. The State cannot quarter troops (members of the organized militias) in your home either. The State must conform to certain rights in any trial. The State cannot compel you to testify against yourself among them. The 6th amendment also applies. You have the right to a speedy trial in any State. The 7th and 8th amendments also apply. So do the 9th and 10th. Indeed, most of the amendments apply to the States as well as the federal government. They cannot practice slavery. They cannot ignore the right of the federal government to protect its own borders.

    One that does not apply is the 1st amendment. It applies only to Congress (that is, the federal government). Each State can limit speech, impose religious requirements for office, or any of a number of things. States today do impose limits on speech (the 'fire in a crowded theater laws', for example). No State is currently requiring a religious affiliation for holding a State office, but they can if they modify their own constitutions to do so. Currently, there is no significant movement in any State desiring to do so.

    There are some here that believe the courts have applied 'incorporation laws' upon the States. They are wrong. No court has the authority to change or interpret the Constitution of the United States.

    I think we are in agreement that gun rights are fundamental Natural Rights enshrined in the Constitution for good reason. But if anyone at the constitutional convention had misunderstood the restrictions being placed on the federal government by the Constitution to apply to the states, the Constitution would never have been ratified. Near total state sovereignty was what was authorized and put in place. States can do what they want on guns.

    States did indeed value their sovereignty. It is why the 2nd amendment specifically mentions the right of a State to defend itself (using militias).

    The people have a sovereign power too, over their own, their families, and their property. Collectively, they formed sovereign States (or colonies). Collectively, THOSE formed the federal government, sovereign in it's territory, and given specific powers. The States also agreed, at tthat time, to place upon themselves the requirement that each State provide a republican form of government and also many other agreements. Those agreements are still in place.

    Sovereignty is shared, the people, the States, and the federal government. If there is any conflict, the constitution forming the State or the Constitution forming the federal government is very specific about the power each has. All other powers are retained by the people. See the 9th and 10th amendments, and Articles I through VII.

    Virginia and New York refused to ratify. The Bill of Rights was specifically added to ensure them the federal government would be restricted in all the specified ways.
