That is a defense, but manslaughter is when the person does not intend to kill the person. Murder is when the intent is to kill (although there may be a defense to that crime).

In Texas, there is "capital murder" and "murder". Seems like this was the correct charge.

The capital murder laws (murder for hire, killing a police officer or firefighter in line of duty, while committing a felony, etc.) were passed in response to the 1970's Supreme Court decision striking down death penalty laws because so few people actually received the death penalty. States had to narrow the range of murders subject to that penalty to those examples the public was most likely to find more serious and give the death penalty.

It appears that the "murder" charge in Texas is fairly equivalent to second degree murder in other states.

2nd degree murder in Texas is when it was done under sudden passion (but still intended). 1st degree is when the person intended to shoot the victim. Premeditation is not really a factor since premeditation can be formed in a split second.

If the prosecutor believed it was self-defense she would probably not have been charged. If the jury believed it was self-defense she would have been found not guilty. Self-defense is an affirmative defense meaning the defendant must prove the facts to support her case.
