He was a Patriot because he understood that the power of the States trumps the Federal Government.
He was a gentleman because when confronted with losing the war, he peacefully surrendered instead of the alternative, which was to shed the uniform, go guerrilla and pick off Union soldiers from second story windows, woods along roadways and every rock and hiding place back to Washington. You know, like the colonists did against the Brits.

Was it lawful for the CSA to violate American sovereignty by attacking our military installation? That's actually how the Revolutionary War began, when the Brits tried to seize a colonial armory.
America would likely have been better-off if Lee had organized a #Resistance. It would have led to a greater death count for the former CSA, meaning fewer people to cause trouble later on down the road.
