A really interesting but complicated new area is two American citizens who have a child by a surrogate and neither parent is American or variations thereof especially when same sex couples are involved.

No, silly Subject to the jurisdiction can change through one's life. If you live in Uzbekistan, but are an American citizen, and go speeding down the road, you are not subject to the United States jurisdiction unless certain circumstances apply regarding tax law. If you are in Alabama you are almost certainly Subject to the Jurisdiction of the United States, even if you are a Cuban Citizen.
