    A poorly dressed Hispanic looking man walks along the American side of the border...

    He is confronted by border patrol agents, who decides if he is an American citizen or not?

    assuming he has no papers..
    he'll either claim asylum if he's illegal or claim residency.. either way he's processed into the USA

    there are some adjustments need in the asylum laws..immigration law is complex -i'ts too early for me to do the research for you, but the fact of the family "units"are the big problem.

    I'm not even sure if this example would qulaify for REMAIN in Mexico - i think nt.

    The problem is in the NUMBERS that overwhelm the facilities and lead to release in the interior without a hearing.

    how do you know he's American? the scenario I used was no papers.
    I'm not 100% sure about border protocol -i might be off in that the migrants have to be seen crossing
    to get arrested/processed. don't know.

    But if he's a migrant, that's what he wants-to get arrested so he would go along with it

    citizen or legal resident.
    Like I just posted,he might not even get arrested if he wan't seen crossing ( I don't know).

    If he's legal, no doubt he would protest
    if he's a migrant he would go along with getting arrested..

    in the long term you would think so, but it really doesn't help because the Central American governments are corrupt and the money doesn't get to the locals in most cases

    Tunnels work worldwide, too. So do ladders, wire cutters, boats and planes.
