New evidence suggests Jussie Smollett orchestrated attack

Chicago (CNN)Two law enforcement sources with knowledge of the investigation told CNN that Chicago Police believe Jussie Smollett paid two men to orchestrate the assault.

The brothers, who were arrested Wednesday, were released without charges Friday after Chicago police cited the discovery of "new evidence." The sources told CNN that the two men are now cooperating fully with law enforcement.

Smollett told authorities he was attacked early January 29 by two men who were "yelling out racial and homophobic slurs." He said one attacker put a rope around his neck and poured an unknown chemical substance on him.

The sources told CNN that there are records that show the two brothers purchased the rope found around Smollett's neck at an Ace Hardware store in Chicago.

Smollett gave his first detailed account of what he says was a hate crime against him, and the aftermath, in an interview with "Good Morning America" that aired Thursday. During the interview he expressed frustration at not being believed.

"It feels like if I had said it was a Muslim or a Mexican or someone black I feel like the doubters would have supported me a lot much more," Smollett said. "And that says a lot about the place where we are as a country right now."

CNN's attempts to reach both Smollett's representative and attorney Saturday were unsuccessful.

The two brothers who were interrogated by police investigating the alleged attack on Jussie Smollett purchased the rope that was found around the "Empire" actor's neck, sources told ABC News Saturday.

Olabinjo and Abimbola Osundairo agreed to cooperate with authorities after detectives confronted them with evidence that they bought the rope -- allegedly used in an attack that Smollett described to police as laced with racial and homophobic slurs -- at an ACE Hardware store, sources said.

Detectives have now shifted the investigation to determining whether Smollett made up the entire story, sources said.

After initially considered persons of interest, the brothers were detained and become potential suspects, police said. When they were threatened with to be charged with battery and hate crimes, they agreed to work with detectives, the sources said.

Sources say at least one of the brothers bought the rope used in the incident at Smollett’s request. The sources also say the “Empire” actor paid for the rope, which was purchased at the Crafty Beaver Hardware Store the weekend of Jan. 25.

The brothers were paid $3,500 before leaving for Nigeria and were promised an additional $500 upon their return.

The sources say plain red hats worn by the brothers were bought at an Uptown beauty supply store and that the attack was supposed to happen before Jan. 29.

Smollett claims two men attacked him in Streeterville early Jan. 29 as he was heading to his apartment. He said they yelled racial and homophobic slurs at him, poured a chemical on him and put a rope around his neck.

The brothers are now cooperating with police.
