dec 11 2018Former Arizona lawman Joe Arpaio sued CNN on Monday, arguing the cable outlet inaccurately labeled him a “felon” in a broadcast and has made no efforts to correct its mistake.

Mr. Arpaio was found guilty of a misdemeanor contempt of court last year, not a felony — and was quickly pardoned by President Trump. He has asked the courts to expunge his original misdemeanor conviction, in a case that’s still pending.

In his lawsuit, filed in federal district court in Washington, D.C., Mr. Arpaio also sued Huffington Post and Rolling Stone, which he says also made inaccurate statements about his legal troubles.

Huffington Post reported that he was “sent to prison” for his conviction, but he says he never served a day. He said the article was uncorrected at the time of his lawsuit — though by Monday night a correction had been appended.

Rolling Stone did “silently” change a web story inaccurately labeling him an “ex-felon,” Mr. Arpaio says, but he argued that without alerting readers to the change anyone who read the original piece wouldn’t know of the inaccuracy.

One issue with a libel suit is showing damages. The usual calculation of damages would be the idea that there is reputational harm, but with someone like Arpaio, his reputation is already so putrid that how much harm can be done? It seems like one of those cases where even if he wins, CNN will be ordered to pay a nominal sum, like one dollar, to acknowledge they screwed up but also that he suffered no meaningful harm.

The other problem for Arpaio is that he's a public figure, which means to win he has to show that CNN called him a felon despite knowing he wasn't, or with reckless disregard about whether he was. If this mistakenly slipped through the fact-checking process and they published a retraction when they spotted the error, they're likely fine. In the US, First Amendment considerations give people wide latitude when publishing things about public figures. That's why, for example, Obama couldn't just sue Trump when Trump was pushing the lies about him not being born in the US.

It really is indefensible for anyone to call joe a felon since that is easily checked on the internet. If CNN did this, they might have to pay a bundle. It's not like calling joe a racist or idiot. Those are vague terms while felon is not.
