    Default Neo-Nazi Harassment Not Protected by First Amendment, Judge Rules

    A lawsuit accusing the publisher of the neo-Nazi site Daily Stormer of coordinating a “terror campaign” of online harassment against a Jewish real estate agent cannot be dismissed on First Amendment grounds, a federal judge in Montana ruled this week.


    In his ruling denying a motion to dismiss the lawsuit, Dana L. Christensen, the chief judge for United States District Court in Missoula, Mont., wrote that the real estate agent, Tanya Gersh, was a private citizen, not a public figure, and that the publisher, Andrew Anglin, incited his followers to harass her as part of a personal campaign.

    The events that spurred the lawsuit began in the fall of 2016, when The Daily Stormer published a series of articles attacking Ms. Gersh, of Whitefish, Mont., for her interactions with Sherry Spencer, the mother of the white supremacist leader Richard Spencer.

    Nope. According to this "judge," only "a private citizen, not a public figure" is protected by the 1st. Amendment from a “terror campaign” of online harassment.
    Since this forum is a public forum and we posters here could be considered "public figure(s)", guno and all the other racists and bigots are free to harass.
    I wonder if this "judge" consulted "Mad Maxine" Waters before reaching this "double standard" decision of allowing a "public figure" to be harassed?
    So Jack, according to this "judge," you too can also continue you're harassment and insults of Christians...
    Common sense is not a gift, it's a punishment because you have to deal with everyone who doesn't have it.

    Since there is no government action, I am not sure the first amendment even applies either way.

    I've always thought harassment is harassment, no matter who is being harassed. I'd say it's safe to say almost every one of us here has been harassed at one time or another by another poster, and I am also guilty of it, but it comes with the territory. I'm generally not offended much unless one of my family members are insulted, especially those who are deceased, but I sure as hell won't bring a lawsuit against them.
    Insulting a poster's family member is a personal line I won't cross though.

    Hey, ... I'm doing this genealogy search and finding a lot of ancestors that were Quakers around Philadelphia, PA in the 1700s. Seems like they all like to have 10 kids ... and then marry each other.

    Either way, the thread is about the first amendment ruling by the judge. I do not see the first amendment even applying without government action. People talk smack all over the internet. It is par for the course. I don't think many people outside those amazon/goodreads people know much about anybody's real life. After some PM's back and forth, I sent owlwoman some plants. I deleted her personal information from my PM's almost as soon as I had it, and then tossed her address after I had sent what I sent and she confirmed receipt. Other than her state, I don't recall a thing about it. I have done online plant/seed swapping with people online since I was in my early teens. No matter what site grudge I may have with someone over something, it has never been personal. One woman on another site whom I loathe with every fiber of my existence as perhaps the most hateful woman on the planet and I have traded back and forth several times and I have bought some pretty expensive plants from her as well. Business is business. The rest is jetsam and flotsam to pass time.

    i can't believe this shit ass suit was even filed. the 1st Amendment does not prohibit PRIVATE citizens from crap, it restricts GOVERNMENT!!!!!!
    A sad commentary on we, as a people, and our viewpoint of our freedom can be summed up like this. We have liberals and conservatives, Democrats and Republicans, yet those very people look at Constitutionalists as radical and extreme.................so those liberals and conservatives, Democrats and Republicans must believe that the constitution is radical and extreme.
