Supreme Court Rules California Must Free Tens of Thousands of Inmates

sharply divided Supreme Court Monday affirmed a controversial prisoner reduction plan forced on California prison administrators that requires the state to reduce its inmate population by tens-of-thousands to ease overcrowding.

The 5-4 decision authored by Justice Anthony Kennedy, a California native, is a wholesale acceptance of a ruling by a special three-judge panel tasked with resolving chronic overcrowding in the state's penal system. The February 2009 decision orders California to reduce its prison population that has at times run nearly double its capacity. Approximately 37,000 to 46,000 inmates will have to be released in order for the state to comply with the ruling.

i'm torn on this decision. constitutionally it seems sound, but i just don't see how the conditions could be so bad that it violates their constitutional rights. 3 squares a day, tv, go to college etc....and it sets a bad precedent.

The Court found that conditions were so bad that there was a preventable or possibly preventable death in California correctional facilities every 5 to 6 days. I know that they get to watch TV and all, but access to adequate medical care for prisoners is kind of important, too.

impossible. we've had many courts over the last few years tell us that conditions in jails and prisons are now so great, that there is no longer any common law right to resist unlawful arrests or entries.

key word - possibly and the findings were made by a left wing judge...and i know for a fact if a right wing judge had made the opposite finding, you would disagree on principle. conditions now are now what they were at the time of the finding...that should have been given consideration. if i recall the lower court case there was much debate about the actual findings by the court. nonetheless, that is what the court ruled and that is why i'm torn on this, if in fact the conditions violate the 8th, then is the remedy to order their release? iirc....there are numerous other cases, including scotus, that have held the remedy is NOT to release them, but to make condiitions or treatment that do not violate their constitional rights.

after reading more of the decision....the court did leave open the alternative that CA could extend the time to release the inmates in order to remedy the wrongs....so CA has an out and we won't be seeing a mass exodus in the next couple of years.

I am dishonest? How many years did it take the prisoners lawsuit to reach the Supreme Court? Do you even know? I would like to see you spend one 24 hour day in one of those prisons, then you could honestly opine on how well they live. You are a pathological liar who is unaware of his pathology. what if they release those who aren't US citizens back in their own countries?........

Actually, if they follow Federal law they are supposed to notify ICE before they release any of them and hold them until ICE picks them up. It is also a felony to re-enter the US if you were deported for a conviction. So, the only people who actually commit a felony entering the US are those who are illegals who are deported as they get out of prison (if they were convicted of a felony that is),.
