The Pima County Regional SWAT team fired 71 shots in seven seconds at a Tucson man they say pointed a gun at officers serving a search warrant at his home.

Jose Guerena, 26, a former Marine who served in Iraq twice, was holding an AR-15 rifle when he was killed, but he never fired a shot, the Sheriff's Department said Monday after initially saying he had fired on officers during last week's raid.

Six days after Guerena was shot, few details about the investigation that brought the SWAT team to the southwest-side home Guerena shared with his wife and their two young sons are known. Guerena's role in the narcotics investigation is unclear and deputies would not comment on what was seized from his home.


So Pima county murders an innocent man in his own home, refuses to release any information about the whys and wherefores of this so called raid, and no doubt that it will all be justified and no charges against any officer will ever be leveled, but don't doubt that the county government will settle this case for 7 figures to avoid it coming to court and a jury ruling against them.

if the warrant is proper and he pointed the gun at officers (as they say), no problem. if the warrant is proper and he did NOT point the gun at officer and was not in any other way threatening anyone's life....1983 lawsuit and if criminally guilty, the police should be charged.

it is relevant...in determining the threat....if he pointed a bow and arrow at them and they responded with like force....uncalled for....it matters very much what force you are faced with in determining whether it is self defense or justifiable police action.

It's deadly force. He could be pointing a muzzleloader at them. It makes no difference.

you're wrong. for example....if he points a knife...then it would be unreasonable force. point an automatic rifle....you get reasonable force. i don't know all the facts...but that is generally the result.
 
it's a man's right to resist unlawful arrest. you know how I can tell the cops are lying? they refuse to say what they found in his house which means they found nothing. If they had found something, they'd be trumpeting it to all the papers to show their justification. they murdered a man trying to defend his family and home.

Guerena was a Tucson native and Flowing Wells High School graduate. He joined the U.S. Marines in 2002. He served two tours in Iraq in 2003 and 2005 as part of the Yuma-based MWSS-173

he was entitled to be a badass as well as own the gun. gun culture had nothing to do with it.

The rate of fire, assuming it is not an NFA Class III item, is the same as any semi-auto. One round per pull of the trigger.

The worst thing about these raids is that the homeowner may or may not know there is a warrant until AFTER armed men rush into their home.

second, it wouldn't be the first time a cop or group of cops have killed during SWAT raids, whether the victim was armed or unarmed
third, he would still be alive today if your government would end the unconstitutional war on a naturally occurring plant.

Topper, what has happened in many cases is the SWAT team does NOT announce themselves ("No Knock" warrant). Some homeowner suddenly has armed men busting into his house and he responds as many of us would respond. Perhaps in your household the response to a breakin is to curl up in a fetal position and hope they are only "sorta" bad guys.

If the man they shot knew they were cops with a warrant, he had no reason to brandish a weapon. If he didn't know, then he was defending his home and family from a serious threat.
