Well, someone said to say "this" so you can do "this"... So, at this point, if I were hired to help him, my job would be to give arguments in that manner.

Again, I just cannot believe that they are working towards political change, terrorism has specific definitions, I have a difficult time trying to stretch that meaning to a monetary enterprise, however criminal it might be.

Any ship shot by any US ship has the potential to still have a fireable gun on it, or other weapons within it that potentially could be recovered and used and that is EXACTLY WHY the US service men are NOT given any discretion to say as you do, "i do not believe they are disabled... i think they might have access to more weapons if they can turn the capsized ship over... etc' and then just5 fire on them and kill them.

The Statutes are crystal clear to avoid exactly what you are doing and that is having each and every service person, in the heat of battle, jsut say 'I thought...' as a reason to then kill them.

The Statute says they MUST be considered 'out of battle'.. FULL STOP.
 
I heard that Hegseth lied and claimed fog of war when there is a 14 minute recording of top commanders watching clear video of survivors clinging to wreckage.

This was murder....clearly illegal under international law.

I have no idea if they were collecting them... but if so, I think they were terrified that the people who made them go out on those boats would kill them should they survive.

They were wet and unusable, they were basically lost at sea, they were not worth killing two people over, they could have very easily been confiscated by the military. If a 'weapon' is disabled when it can no longer be used to harm the enemy, these drugs were clearly disabled.

I have seen noone call for TACO to be tried in the Hague. I do think this silly killing should end. I think these drugs (even if you want to pretend they are a weapon of war) were rendered unusable, and that our law should be obeyed.

Ok as a 'devils advocate' argument, i would agree that is a version of what they will try and argue but it has no real value based on what i post above in the Code. They cannot over come that the code does not allow for discretion.

But cases like this, should anyone ever be brought to trial in the US (they almost certainly will not) often are presented to give just the jury a way out of finding the US service people liable.

What would "Collecting" mean in this instance?

If your boat is blown up in the middle of the ocean, will gather and cling to anything that is managing to float and has any buoyancy. Your burning ship you are clinging to might have enough it survive the fire that you can continue to use it but that is not guaranteed.

If the cocaine is packaged in a way that it has air trapped in side, and you can cling to it, or gather it together to make some form of flotation device you will do it.

Your goal will be to try and pull together as much stuff as possible and get as much out of the water as possible knowing with so many dead bodies floating in pieces nearby, sharks will be incoming.
