A federal judge has indefinitely blocked President Donald Trump’s ban on transgender service members, dealing a major defeat to a controversial policy the president resurrected from his first term.

In a scathing ruling, US District Judge Ana Reyes said the administration cannot enforce the ban — which was set to take effect later this month.

Reyes, an appointee of former President Joe Biden, wrote that the ban “is soaked in animus and dripping with pretext. Its language is unabashedly demeaning, its policy stigmatizes transgender persons as inherently unfit, and its conclusions bear no relation to fact.”

“Defendants have not provided a legitimate reason for banning all transgender troops,” she wrote.

The judge said she was pausing her preliminary injunction until Friday morning to give the administration time to appeal it to the DC Circuit Court of Appeals.

Her previous legal work included for the Feminist Majority Foundation and opposition to California prop 209 (gay marriage). She further has previously done pro bono work for illegal immigrants and on illegal immigration issues to support open borders.

In other words, she has a vested interest in this case and a clear position from the standpoint of a long work history that would oppose the Trump position on transgenders in the military. That means she should have recused herself as being unable to be impartial in this case. But as with the Left in general, she sees her being the judge on this case as an opportunity to further her personal political agenda.

Her political bias was sufficiently bad that she barely got confirmed to the bench (51-47) by the Senate in a party line vote.

That's where this case is at right now.

No, he doesn't. Trump can simply use their higher level and sustained need for medical care above and beyond the average military member as justification. But proving they are unfit is relatively easy on that basis as they also require more mental health care.

The Defense Department treated 1,525 service members between July 1, 2016 and February 1, 2019, who were diagnosed with gender dysphoria, a condition of extreme distress from not identifying with one’s biological gender. Currently about 1,071 are serving, including 20 senior officers.

The military spent about $8 million on transgender care, including about $5.8 million on psychotherapy and about $2 million on surgeries mostly for breast reductions and hysterectomies. There were about 23,000 psychotherapy visits and about 160 surgeries.

Those are costs that otherwise would be ZERO if transgenders were not allowed to serve. That's a $16 million savings at a rate of about $4 to $5 million-a-year. That's a savings of about $4 to 5 thousand dollars a year per transgender service member versus not having that expense at all. Add in the fact that each transgender required about 20 psychotherapy sessions that would have had some impact on unit readiness, along with the surgeries having a big impact, it argues that the military doesn't need transgenders serving. Their miniscule numbers don't justify the added cost and complexity of having them serve.
