The real problem is that just because Trump's sexual assault on Ms Carroll didn't meet the legal definition of rape in NY doesn't mean it wasn't rape under any other definition. OJ isn't going to be suing him for calling him a murderer after he was found not guilty because people are allowed to have opinions and use definitions that aren't legal ones. The truth is a defense against slander and libel.

Trump's lawyers may get lucky and avoid being reprimanded for filing a frivolous lawsuit.

Trump is a loser who has been found to engage in sexual assault or what is classified as rape in many States outside NY.

Finger or penis forced, undesired penetration is considered rape in many, MANY jurisdictions and that is why this case will be thrown out and Trump will be a loser yet again.

E Jean does not say, 'the jury found he raped me', ...she does say that she still considers it that he raped her, which is fair for her to think and say.


The fact that many States agree is her defense. It is simply a difference of opinion over what is included in the act, and you cannot sue thinking your view is the only one allowed.

Yup.

NYS is one of few States that separate out different forms of penetration and call some rape and the others just sexual assault.

No one is forced to agree with NYS on that division when the common definition of rape would include digital penetration as Trump was found to have done to E Jean.

it is fine to say 'under NY law it will not legally be found to be rape', but that does not mean any individual cannot hold to the more accepted definition of rape, when the speak on it.


E Jean, is almost certainly going to get a massive ratchet of punitive damages Trump will have to pay her, over his continued attacks on her, and defamations. Do not be surprised if this case filed by Trump, is not also entered in to evidence of Trumps continuing campaign of harassment and they jury UPS his penalty amount.


Trump is saying thru words and actions that no jury is going to stop him defaming and harrassing E Jean. The jury needs to really put that to the test. That is exactly why punitive damages came to be a thing in the first place. I hope we see an award around $50MM this time. And if he does it again, then $200MM. It should go up exponentially until he is forced to follow the law and not abuse his victims further.

To be 100% clear...

NYS does not control the sole or even most common definition of the word 'rape'.

The Jury did not say, in any way Trump did not rape her. That was NOT a finding. They said that because E Jean, herself was unclear if it was just a finger or his penis that penetrated her, they could only find the sexual assault happened and that is because NYS is one of a few States only, that classify those as different. Most States do NOT make that distinction and in those States they see Trump as being liable for Rape for digital penetration or penis penetration.


Therefore...

- it would be defamation if E Jean says 'the NYS jury found Trump liable for rape' (she never said this)
- it is NOT defamation for E Jean to say 'she still considers him to have raped her' or 'believes he raped her'.


She is under NO OBLIGATION to agree with NYS narrow definition of the word 'rape' when speaking to what happened to her and she can use the more common definition detailed up thread, or the definitions used by other States.

this case WILL be thrown out, and likely used by E Jean to get even more punitive damages for harassment by Trump.

Not hard to do actually. Anyone who can get him into a deposition or on the stand is almost certainly not only going to come out way ahead of where they went in, but with whole new expectations to settlements and indictments and convictions.

Trump is the perfect avatar for his base. Stupid to his core and out maneuvered easily by E Jean and her lawyer at every step.
