You’re using very convoluted logic. There would still be a trial, however the lawyers would see classified documents, that they were not authorized to see. We now know where the church is head is on this.
 
I think the jurors should be also be required to. They will have to see the Classified Information as well.

It's not the hardest thing to qualify for, as even I have had Security Clearance before in my career. Yes, even Top Secret Clearance because of the Javelin Missile Contract and other governmental contracts we were working on at the time.

Credit and criminal history checks will be conducted on all applicants. For a Top Secret security clearance, the background investigation includes additional record checks which can verify citizenship for the applicant and family members, verification of birth, education, employment history, and military history.

Easy peazy for most people!

If Trump uses the defense that he declassified them, then he will have to testify to the fact, that would be fun!

I can see it as a reasonable order. When the documents in question are shown in court to the jurors (who won't have a clearance), both sides' attorneys can state on the record that they saw the originals, including the redacted parts, and can verify their contents and classification status, without the necessity of revealing the contents to unauthorized jurors/spectators.

Imagine the RW outrage if, at the Pride party at the WH the other day, if Biden had shown the boob-flashing attendee a top secret document, while saying "I just now declassified this. Look!" :laugh:

I don't see where a judge has the authority to "order" it.

Well, Jurors have to see the evidence that is presented in court. When the documents are being discussed in the trial, people's names will be changed to person #1, and person #2 etc, and places will referred to as place A and Country B etc., when they are discussing the Top Secret information on the documents, so as not to reveal anything to the public! This must be established before a Pre-Trial hearing even begins.

But the Jury will have to read the documents to be able to know what they are talking about. And to my understanding nothing will be redacted. So the government will have to select which documents will be allowed to be used in the trial. The prosecutors are going to want to use the most Top Secret examples, and the government/military will want to use the least important, or with the least risk imposed, so they will have to negotiate all this before the trial.

Under the Constitution, the President as Commander in Chief of the Army and Navy is the supreme military commander charged with the responsibility of protecting and defending the United States.

So, in terms of the Military secrets that Donald Trump was exposing to the public, THOSE, IN MY OPINION, should be handled by a Court Marshal, and decided in a military court- WHERE EVERYONE ALREADY HAS CLEARANCE!

That is just my opinion, but that is what I feel is best for the country, and the way some of these charges should have been handled.

Donald Trump should have been Court Marshaled as Commander In Chief. And if convicted, he should have to go to a military prison facility- INSTEAD OF CAMP CUPCAKE!

You don't need a clearance to look at declassified material. Nobody would ever ask you to get one if the documents are declassified...

The Judge is basically saying that until it is decided we treat the documents as they were marked. If his defense is "they are declassified", then we'll get to hear on whether a President must follow rules laid down noting how agencies can declassify or whether plenary power is actually plenary...
