A crime has not yet been charged. Trump's refusal to provide evidence of declassification because he doesn't want to give up his criminal defense would point to there likely being a crime here and Trump's lawyers fully expect a criminal indictment.
Just like in NY, Trump can't use a criminal defense to refuse to provide evidence in a civil case without consequences in the civil case. His refusal to provide the evidence is seen as lack of evidence on his side so the preponderance of evidence standard comes into play. DoJ- evidence of documents with classified markings. Trump - zero evidence refuting it.

Exactly. Accurately and succinctly stated. Trump can't just claim that he declassified the docs. He has to PROVE it. Just like the Election Fraud charges. It's not enough that he deemed the 2020 election rigged (although it's enough for the MAGA morons). Courts demand proof, not hearsay or conjecture. It's the foundation of our legal process.
Without proof the docs are declassified, then the docs are deemed CLASSIFIED. And if they are indeed classified, then Trump is guilty of illegally possessing classified documents without authority. He is not above the law. And it doesn't help that the Archives office asked him if he'd returned ALL the classified documents in the June 3rd meeting and he said 'yes'. That is obstruction and carries with it more penalties. Yeah, Trump is definitely fucked. Even his own lawyers think so.
Imagine if his sentencing is House Arrest with an ankle monitor in Mar-a-Lago with NO access to the internet or social media. That would slowly kill him. Wouldn't that be funny?
This is a civil case and if Trump provides no evidence of declassification then under the rule of law the documents are deemed classified.

Since you claim to know what the burden of proof is in a civil lawsuit, perhaps you can tell us what proof Trump has provided that the documents marked classified were declassified by him.
I never said a civil suit was going to prevent Trump from running for President. He is free to declare his candidacy at any time. His legal troubles may make people think twice before they decide to vote for someone else instead of Trump.

AND...since the original request from the National Archive indicated that they wanted any documents marked CLASSIFIED...it doesn't matter whether they are declassified or not. THEY WERE MARKED AS CLASSIFIED...and that is the matter in dispute.
