Criminal and civil courts have often ruled that verbal contracts or promises made prior to a written contract are enforceable and the failure to follow through on the contract results in harm or fraud. If the verbal contract is only between 2 people it is hard to prove. If there is a pattern of verbal promises and then not following through on the written contract then it is easy to prove. You have multiple witnesses all saying similar things. Judge Judy would not let your argument fly.

The lawyers filing the lawsuit are lawyers. The lawsuit will state the reasons for the fraud. Making promises with no intention of keeping them in order to get a contract is fraud under the law. Has been that way for over 100 years.

The consent form was written in several languages. The problem is not the language on the form but any promises made prior to them signing the form.
