The government has proof that the documents in trumps possession weren't allowed to be. Therefore they were stolen.
The only reason at this point to be concerned about classified vs not is the hope that he'll be convicted of espionage if they are still classified, IMO. Otherwise it's not as relevant as is the fact that he KNOWINGLY kept government documents after his term expired, and refused to surrender them. At least one attorney told him *last year* that he faced legal/criminal liability for possessing them and refusing to return them. There goes his claim that he didn't know.
