It resulted in the deaths of five Americans including the brutal beating death of one police officer and the injuries of over 50 more. Now they are threatening to attack all State capitals. On the steps? Yes, they were committing a crime (Trespassing), participating in a joint effort that murdered at least one police officer.

In the interest of fairness and specificity, just trespassing on the grounds of a Federal building is not a crime, it is a petty misdemeanor, which does not rise to the level of criminality. However, any destruction of property, seriously bodily injury or possession of a weapon during that trespass is a felony. Standing on the capitol steps? You get a fine. Start breaking windows, destroying property, attacking police officers, carrying a firearm....... you are a felon, and you will be caught. Even if only the people who directly participated in those activities are charged, that's still probably a majority of that mob.

But I'm picking nits, fundamentally we are in agreement. I'm not sure about that specific trespass statute (the one you mentioned with intent), and that may very well be more than a petty misdemeanor. I just looked up the charge for trespassing on federal property, so you could very well be right about that. Above my pay grade.

It actually did, it was part of the mob, and as you may or may not know, those particular steps are always closed to the public, because they are just outside the Senate floor. There is a reason they are closed off and protected. Before the mob broke the windows, the floor was evacuated because they were on those particular steps. In a mob, you can be prosecuted for the actions of the entire mob.

No, if you want to decriminalize something, you make it a civil infraction punishable by a fine. In Florida, every single Misdemeanor, even a second degree misdemeanor is punishable by at least 60 days in jail. Speeding is not a crime, its a civil infraction punishable by a fine.
