By 'on what basis' I really meant on what authority. I'm not sure what a national standard would do to help alleviate the claims of cheating. Those claims are completely unsubstantiated. They would have been made regardless of what rules were in place.
Moot point anyway. I don't see dems and repubs trying to work anything out in the near future. If one is really bothered by the politics of the area they reside in they can always move to where like minded folks live.
 
Yep. Every state will just sue every other state, asking that that states election results be tossed in the trash. The Supreme Court can hear a few thousand of these state vs. state lawsuits during each election cycle, decide who they want to win, and rule accordingly. Sounds like a great idea, right? If every Red state sues every blue state and vice versa, we can have over a thousand lawsuits going. Cool.

That's exactly where we are headed unless Congress figures out a way to put a stop to the bullshit.

The Supreme Court can get an assist. MHO they should not just dismiss this lawsuit without comment. They should issue a unanimous, scathing decision that puts a stop to these frivolous lawsuits.

not following Legislative intent so the states have standing

Roberts won't want to touch it ( he never does anything) but it's possible a 5-4 majority will
