We grant the
Government’s applications to stay the injunctions, to the
extent the injunctions prevent enforcement of §2(c) with
respect to foreign nationals who lack any bona fide rela-
tionship with a person or entity in the United States.
We leave the injunctions entered by the lower courts in place
with respect to respondents and those similarly situated,
as specified in this opinion. See infra, at 11–12.
Crafting a preliminary injunction is an exercise of dis-
cretion and judgment, often dependent as much on the
equities of a given case as the substance of the legal issues
it presents.
So,
six Justices decided to stay execution of the most choice brutality of the Trumpy's Muslim ban, for instance, leaving stranded folks who tried to return home to their family in the U.S., or their place of employment, from abroad. Just the most seriously mouth-breathing of Justices (Alito, Thomas, Gorsuch) sided with the Trumpy in even this respect.
Moreover, the opinion isn't based on significantly differing interpretations of the Constitution or the laws, but at least as much "on the
equities of a given case", meaning who ends up harmed (more) when one or the other course is taken.
That doesn't really look like a "victory" to me, much less the decisive victory the Trumpy was crowing about, even though the howling about "national security" seems to have done most of its work, as so often.
