Scalia redefined the murkiness of "Original Intent" to the clarity of 'textualism' -that is a YUGE accomplishment..
It's a new philosophy by stripping out the guesswork

"Living Document" is just making stuff up.
 
Would there be any bitching from the left if the court was loaded with liberals to dismantle the constitution? What? Does the reality of facing something like the ROOSEVELT COURT scare the hell out you communists? Afraid of what real constitutional judges might do with the communist precedents over the past 80 years?

I never hear any liberal bitch about the historical reality of a packed Roosevelt court...hell he was doing so good he actually wanted to seat several more liberals on the court, he demanded 15 judges be on the court....ever hear of the " switch in time saves 9", or The court packing reform bill of 1937? Now its priceless to hear the communists bitching about others wanting to pack the court.

They need to make stuff up because they consider the document an impediment to their conception of rights.

Obama has said as much.

Which is why I don't get the #NeverTrumpRumpers. In a sense, much of what they fret over about Trump is trivial compared to what Hillary has in mind with SCOTUS. The damage either of them can do in four years can be undone---possibly as soon as the next midterm election.

But two or three lifetime appointments on the Court would be a game changer. Of course, since liberals are unable to get so much of their agenda approved by Congress, they rightly drool over the prospect of loading the court with leftist ideologues who will vote in lock step in approving the latest cultural fad.

If Hillary wins, for people who respect the document as it was written, their only hope will be that the new liberal appointees will at least try and play the role of a Scalia. And there's always a chance an appointee could turn out to be not so liberal once they get on the bench.

SCOTUS was never intended to be an echo chamber for either side.

YOU. After all we are a government by the people, of the people and for the people. FYI: The People of the United States is the government...but not all of its people are pro USA, either through ignorance or design...you are the slave of the ideology that you serve.

One does not have to "claim" to be a communist in order to be a communist, one simply has to blindly promote and defend the communist agenda. Just as advised by scripture, "Do you not know that to whom you present yourself to obey, you are that one's slave whom you obey, whether of sin leading to death or of obedience leading to righteousness?" -- Romans 6:16

How is your communism proven? Via the prima facie evidence that your own words have provided....your words of ignorance or premeditation prove beyond any reason of doubt, that you serve a communist agenda. :) You can call yourself....DEMOCRAT....LIBERAL...PROGRESSIVE....SOCIALIST, LIBERTARIAN ...etc., just as you have denied your party of choice's HISTORY ACTUAL, you are just as much a communist as was Joseph Stalin or Mao Tse-Tung.

It has been my experience that regardless of the testable documented and objective evidence provided....your first and only move in retorted argument will be a deflective denial. Its who you are its how you have been indoctrinated. So, I always allow your guild's own words to convict the obvious truth. Its a waste of time to present any direct evidence on an individual basis....I present general testable truths for anyone that is capable of the least amount of critical independent cognitive thought. Nothing to add about judicial activism in that election?

Scalia et al. could have let the political process continue but they overrode it. So effectively five conservative justices determined the outcome of that election, screw the voters.
