Scalia’s controversial remarks about African Americans expose U.S. higher education

That's right, if, but what if they accept you because of your skin color and a need to make the campus feel more diverse? Is that truly in the best interest of the student that academically had no shot but because of something they can't control gets a spot over a student that met or surpassed the qualifications? I think that's really the essence behind why so many people don't like the idea of affirmative action. Someone is punished regardless because of something they cant control, skin color.

Maybe that's why the ethnicity section was removed from the Common App, trying to make it color-blind.

Scalia wasn't stating his opinion. He was referencing an amicus brief on mismatch theory.

How do you not see this as his opinion no matter the context? He's giving his opinion on why he doesn't agree with Garre's arguments.

I’m just not impressed by the fact that the University of Texas may have fewer. Maybe it ought to have fewer."

I agree with Garre who also criticized Scalia's legal reasoning: "This Court heard and rejected that argument, with respect, Justice Scalia, in the Grutter case [which said universities may consider race in a limited way because they have a compelling interest in creating diverse student bodies], a case that our opponents haven’t asked this Court to overrule. If you look at the academic performance of holistic minority admits versus the top 10 percent admits, over time, they — they fare better."

I've read his remarks a couple of times. If I thought they were bigoted i would say so. Scalia is not above reproach. He's asking the question about results of students who have gotten in to a higher rates school than their grades would normally allow. That's a legitimate topic.

Well, lets see.....because Supreme Court Justice Antonin Scalia is obviously not a stupid man and I don't think he means to come across as a bigot....I'll answer.

You make the leap that Scalia was talking about ALL black students when he was talking about only those that required affirmative action to get them entry into college....
So lets make that clear from the start.

Our own public schools have accelerated classes, college prep classes, and even trade school and remedial education....

why is that ?

Some people(students) are just smarter than others and don't thrive in classes they find boring and others don't thrive in classes that are far over their mental ability at some stage of life...
I seen no reason to question that thinking about college students as well....we all learn at our own different paces and we all have our limits....
Many whites as well as blacks or Asians or whatever will not advance in higher education, thats just the way it is, more reality for you...

I makes sense that you wouldn't put an average student into an accelerated class that he or she will have little hope of understanding or passing just because that student is a particular color or from a particular culture....even if that particular color is white....advances should be earned on an even playing field....so its our duty to see that that field IS EVEN FOR ALL.....
