Legislating morality

Sure you can. Just hire a lawyer like yourself and write up the necessary contracts.

There are rights you cannot get by simply writing up a contract. Example... filing jointly on your tax return.

A dumbass libtard telling me what the Constitution seeks. LOL!

In other words, gay marriage provides little, if any, benefit to the state. So why would they want to license such an activity?

And if procreation is the only reason the state issues a marriage license, why do they issue them to couples who cannot reproduce? Why is there not even a question about it when applying for the license?

Again, it's up to the voters in the states, or their elected representatives, to decide what is worth licensing, and what is not.

Do you think that it is OK for a judge to issue an edict forcing a state what to license?

You don't need any sort of license to reproduce.

The purpose of most licenses is to permit an action that would otherwise be illegal or to restrict the action to those qualified. But the marriage license is really nothing more than a means to register a marriage agreement with the state. Frankly, "marriage license" is a misnomer.

Marriage is a fundamental right and so any restriction on it must pass strict scrutiny. There has to be a compelling interest. The state cannot restrict it on a whim and, as has been pointed out, no one has really given any good answer to what interest restrictions against gay marriage serve.

Texas and Alabama are talking about decriminalizing marijuana and Gay marriage is sweeping the nation. Id say liberalism is making huge progress.
