So the law allows a man guilty of rape to have visitation rights in jail? (And I'm assuming the kid has no choice he/she has to visit?)
He would go to jail if she followed through on the charges and if he was found guilty. No he can't have custody in jail but he may be able to sue for visitation, and then custody when he's released.
