trump made the claim it was a personal expense, not a campaign expense, but that still is not a business expense.

Very. It's also breaking the law. This action alone is sufficient to dismiss the case with prejudice and possibly bring criminal charges against the judge. Assuming the jury votes to 'convict' in this way, an appeals court will likely just throw the whole pile of garbage out.
No specification was ever given. There is no crime. Falsification of bookkeeping is NOT a crime in New York UNLESS there is an intent to cover for some other crime, which was NEVER SPECIFIED.
