Is he a veteran? We have all been burned on that before. I remember everyone claiming Randy Weaver was a veteran of the Army Rangers who fought in Vietnam. Turns out that he repaired fences, and I came closer to the action in Vietnam than he did. And he is one of the better ones. Many of the fake war veterans are not even peacetime veterans.

I was 2 years old when most American involvement in the Vietnam War ended. As a baby I was held by a few Vietnam Veterans, so may have spit on them.

In the real world, there were not cases of people spitting on returning veterans. That was a story from after the war.

Veterans are civilians, so the laws do not apply to them. The rules do apply to them. The rules do not have the force of law, but people who are respectful of the US Flag follow the rules.

Usually, veterans would be well enough versed in the rules that they would not break the rules lightly.

The rules say that warn out flags are supposed to be burned in solemn ceremonies, and the ashes buried. The Foreign Legion will do it for you free of charge, though I recommend you give them a donation (it is only right). If he burned the American Flag in protest, I would be very upset with the disrespect it shows the American Flag. Claiming to be a veteran does not change that.
